Handling Your Denied Claim

If you were injured in the course of your employment, you probably filed a claim for workers’ compensation benefits thinking that would help cover a portion of your lost income and medical expenses while you are unable to work. However, not every claim automatically goes through, and some claims are denied even if they are legitimate.

The Appeals Process

As part of the appeals process, you have the right to request a hearing. This is true regardless of whether or not your employer is objecting to your claim. Your hearing before the Workers’ Compensation Commission is your opportunity to produce any witnesses or evidence that support your claim and to refute any evidence that is being used against you.

If the ruling is still not in your favor, you may be entitled to a rehearing in some circumstances. This could be granted if new evidence has come to light or an error was made during your original hearing. Once the WCC issues a ruling that is considered a final decision, an appeal can be filed with the circuit court. At the circuit court level, the burden will be on you to prove that the previous denials were incorrect. Expert witness testimony may become crucial in order to bolster your case.
