Workers’ compensation denial: Things you need to know

Law Offices of Joel L. Katz, LLC Team

If you ever find yourself making a workers’ compensation claim, there are a few things you need to know.

Above all else, it’s a good idea to act as quickly as possible. If you wait too long, you could be disqualified from receiving the benefits you deserve.

Another thing to think about is this: Your claim could be denied for some reason. If this happens, you must know which steps to take in order to fight back against the system.

There are many potential reasons for a workers’ compensation denial, and you need to learn more about each and every one. When you collect the right information, it’s much easier to understand what you could be up against in the future.

Here are some of the top reasons for a denial:

— Your employer says that you were not injured on the job. This is why you want to immediately report your accident and injury, as this can help eliminate any questions. Also, don’t hesitate to speak with others who may have witnessed the accident and can speak on your behalf.

— You did not report the injury in time. As noted above, you should report your injury to your employer as quickly as possible, hopefully the same day.

— You did not receive medical treatment. If you want to receive workers’ compensation benefits, you need to receive medical treatment after suffering an injury. This makes it perfectly clear per your injury type and treatment schedule.

— Claim was not filed on time. This is mentioned above, but it’s worth saying again. You only have a certain amount of tine to file a workers’ compensation claim, with this varying by state. Do your best to make a claim within a few days of your injury. This will remove any fear of taking too much time.

You hope that you begin to receive workers’ compensation benefits immediately after filing a claim, but there are reasons why this may not happen.

If you receive a denial letter, read it from top to bottom to better understand your rights. From there, file an appeal with the hope of receiving benefits in the near future.
