Medical malpractice re fertility, abortion procedure

An out-of-state couple’s dreams of having another child were dashed after they learned that the fertility doctor who’d been treating the wife made a mistake. The couple say the wrong embryos were implanted and then aborted by the doctor without either their consent or knowledge. When Maryland residents are victims of medical malpractice at the hands of medical practitioners involving allegations similar to this case, they may have legal grounds to litigate a medical malpractice lawsuit.

After struggling to conceive, the couple sought help from the fertility doctor in 2013. The wife underwent an in vitro fertilization treatment in early 2014, at which time several embryos were implanted. Two days later, the wife reportedly received an urgent call to come to the doctor immediately.

When she arrived, a nurse revealed startling and upsetting news to her — all 14 of the original eggs remained in a petri dish, which suggested that the wife had been implanted with another individual’s embryos. Without any explanation, the doctor claimed to be checking on the embryos; however, the wife alleges that she underwent a painful curettage procedure, which is one of the most common methods used for first term abortions. The next day, she received an injection that would purportedly stop the wife’s bleeding. However, she later learned that what she had received was a drug, methotrexate, a common chemical abortion drug.

The couple is now suing the fertility doctor, alleging that they did not give him consent before he performed either abortion procedure. When tragic cases such as these occur in Maryland, residents who are victims of medical malpractice may be entitled to file a medical malpractice suit against the doctor — and sometimes the doctor’s employer — in order to seek recovery of financial losses and related monetary damages.
