Maryland wheelchair-bound man dies in recent car accident

Law Offices of Joel L. Katz, LLC Team

A fatal accident recently occurred in Montgomery County that took the life of a man in a wheelchair. The man died on a recent Sunday in May in Rockville after Montgomery County police say he was struck by a car while crossing the street. When a Maryland resident is killed in a car accident due to the negligence of another driver, the victim’s loved ones are typically entitled to file a wrongful death claim against the responsible party.

Investigators said the 57-year-old man was in a wheelchair, attempting to cross a street in Rockville. Police say he was struck by a vehicle in the westbound lanes of the street. The driver of the vehicle was a 29-year-old Rockville man

Detectives are currently continuing their investigation into the circumstances of this fatal collision. Their investigation will include what the traffic signal was showing at the exact moment of the collision, in addition to whether the man was within the parameters of the crosswalk. Police have requested that any individuals with information pertaining to the crash contact them.

Knowing that one’s loved one died from injuries that could have been prevented is indeed traumatic. Added to this trauma, a surviving family may be burdened with the expenses of a funeral and burial, as well as the loss of a loved one’s income. To obtain financial relief, a family may decide to pursue a wrongful death claim in a Maryland civil court. However, to successfully navigate such a claim, sufficient evidence to show the car accident was due to driver error — or another form of negligence on the part of another party — will have to be established.
