Man dies, family files medical malpractice suit against hospital

Sometimes, an individual may go in for a routine medical procedure only to suffer complications and unforeseen side effects later. At other times, an individual may suffer what they feel to be unnecessary pain and/or suffering while in the care of a Maryland medical professional. In some cases, perhaps a doctor failed to diagnose a serious condition during an earlier visit. If any of the above are the case, medical malpractice may have occurred.

The family of a man who died at an out-of-state medical center is suing the center and is alleging malpractice. The suit was filed last month in a federal court out of state. The suit alleges that the 44-year-old man’s condition was misdiagnosed by medical staff and he was mistreated. The man died while in the emergency room on February 18, 2016.

The man had visited the medical center several times beginning February 11, the lawsuit said. Two of the man’s spinal discs were extruded, which resulted in several complications and, later, emergency surgery. The suit alleges that staff did not use a compression device properly to relieve what they believed what a blood clot in the man’s legs. As a result, the clot went undiagnosed. He later died of bilateral pulmonary embolism.

Medical malpractice occurs in Maryland when a medical professional fails to meet the standards of care in his or her area of expertise. A case is considered valid when it meets two separate requirements: the malpractice or negligence was perpetrated by a nurse, doctor, hospital or similar health care provider, and the act directly resulted in the injury, disability, pain and suffering or death of the victim.
